Top GOP Leaders Honor 2015 Republican Lawyer of the Year Recipient Bobby Burchfield

Last month, the RNLA honored Bobby Burchfield as the recipient of the 2015 Republican Lawyer of the Year.  Many gathered to celebrate the accomplishments that Bobby has done for the Republican Party including Senate Majority Leader Mitch McConnell, Republican Party Chairman Reince Priebus as well as President and CEO of American Crossroads, Steven Law.

A few of the highlights from the speeches:

RNLA Chair Randy Evans on Why the RNC Chair was Re-Elected

RNLA congratulates the newly elected RNC Leadership Team.  Also, RNLA Chair Randy Evans wrote in the Atlanta Business Chronicle on Why RNC Chairman Reince Priebus was re-elected.  A few highlights below:
Yet, behind the scenes, Priebus has built a political juggernaut capable of winning elections from county courthouses to statehouses to both houses of the Congress. The distance from where the party began when he took office to where it is today is by all accounts monumental. Now, with a third term to do it, he has set his sights on the ultimate prize for a political party chairman the White House in 2016. . . . 
Every election cycle, Priebus has taken the lessons from the last to build toward the next. When the RNC was so heavily in debt in 2011, he spent the year laser focused on raising money. When Republicans lost the Presidential election in 2012, Priebus ordered a top-to-bottom review. 
In 2014, Priebus not only led a winning team at the ballot box, but he looked beyond the fall elections and focused the RNC on changes to increase Republicans’ chances of winning in the 2016 Presidential election. These changes were not minor tweaks aimed at pacifying unhappy candidates

Reactions to Hobby Lobby Case From Conservative Leaders

Senate Majority Leader Mitch McConnell:
Today’s Supreme Court decision makes clear that the Obama administration cannot trample on the religious freedoms that Americans hold dear. ObamaCare is the single worst piece of legislation to pass in the last 50 years, and I was glad to see the Supreme Court agree that this particular ObamaCare mandate violates the Religious Freedom Restoration Act (RFRA).

Becket Fund Press Release:
“This is a landmark decision for religious freedom. The Supreme Court recognized that Americans do not lose their religious freedom when they run a family business,” said Lori Windham, Senior Counsel for The Becket Fund for Religious Liberty and counsel for Hobby Lobby. “This ruling will protect people of all faiths. The Court’s reasoning was clear, and it should have been clear to the government. You can’t argue there are no alternative means when your agency is busy creating alternative means for other people.” The decision also has important implications for over 50 pending lawsuits brought by non-profit religious organizations.

Speaker John Boehner:
Today's decision is a victory for religious freedom and another defeat for an administration that has repeatedly crossed constitutional lines in pursuit of big government. The President's health care law remains an unworkable mess and a drag on our economy.

Reince Priebus, RNC Chairman:
The central issue of this case was whether the federal government can coerce Americans to violate their deeply held religious beliefs, and thankfully the Court has upheld the proper limits on the government’s power. The fact that Americans had to bring this case in the first place reveals once again just how intrusive ObamaCare is.

Texas Senator Ted Cruz:
This ruling is a repudiation of the Obama Administration’s untenable position that people with sincerely held religious beliefs should be forced to comply with an unconstitutional mandate while a parade of waivers, exemptions, and delays are granted for purely commercial and political interests. In making this ruling the Court relied on the Religious Freedom Restoration Act, which was passed with broad bipartisan support, proving the strength and necessity of the legislation and showing the nation the effectiveness members of Congress can have when they work together to protect religious liberty.

Curt Levy, President of Committee for Justice:
Finally, today’s decision is another legal setback for President Obama’s “pen and phone” strategy of focusing on aggressive, unilateral executive branch actions – rather than working with Congress – and comes just four days after the Court unanimously rejected his attempt to expand the president’s recess appointment power. The contraception mandate at issue in Hobby Lobby was not contained in the ObamaCare law enacted by Congress; instead it was the result of aggressive rule making by President Obama’s Department of Health and Human Services.

Jay Sekulow, ACLJ:
The court clearly recognized that closely-held corporations enjoy religious liberty rights just as they enjoy rights to free speech. American citizens do not lose their religious freedom when they form a corporation and try to live out their religious values in the conduct of their business.

Ed Whelan, The National Review:
This ruling will not lead to the parade of horribles that the dissent trots out. Justice Ginsburg, in her wildly overwrought dissent, offers a compatible reading on this narrow point, as she asserts that the government has shown that there is no less restrictive means that would “satisfy the challengers’ religious objections to providing insurance coverage for certain contraceptives.

The McCutcheon Case Reax: A Victory for Free Speech

Below are a few reactions to the Supreme Court decision for free speech and striking down so-called aggregate contribution limits in McCutcheon vs. Federal Election Commission

—U.S. Senate Republican Leader Mitch McConnell issued the following statement today after the Supreme Court struck down limits on overall campaign contributions to candidates, political parties and political action committees. McConnell had filed an amicus brief, which was argued on his behalf by counsel, in the case, Shaun McCutcheon v. Federal Election Commission.

“The Supreme Court has once again reminded Congress that Americans have a Constitutional First Amendment right to speak and associate with political candidates and parties of their choice. In Shaun McCutcheon vs. Federal Election Commission, the court did not strike down individual contribution limits to candidates, political action committees or parties. But the court did recognize that it is the right of the individual, and not the prerogative of Congress, to determine how many candidates and parties to support.  Let me be clear for all those who would criticize the decision: It does not permit one more dime to be given to an individual candidate or a party -- it just respects the Constitutional rights of individuals to decide how many to support.”

The named plaintiff in the case, Shaun McCutcheon, response is excerpted below:
Today the United States Supreme Court took a stand in favor of our Constitutional Freedom of Speech as codified in our First Amendment.  First Amendment Free Speech enables us to support candidates for public office who share our views.  While I understand some base limits on the dollar amount of single contributions, limits to the overall number of candidates, parties and committees are nothing more than unnecessary limits to 1st amendment freedom.  The Supreme Court has reaffirmed the unconstitutionality of aggregate limits.

With the ruling, we continue to chip away at the long entrenched status quo from the grassroots - a status quo that has kept challengers, better ideas, and new entrants to the political arena mostly locked out.  Ensuring that citizens are able to contribute to multiple candidates or causes who share their views only provides further support to a system in which "We the People" hold the ultimate reins of power.

I commend the Supreme Court for their decision to defend our freedom.

Reince Priebus, Chairman of the Republican National Committee (the “other” McCutcheon plaintiff) commented:

“Today’s decision is an important first step toward restoring the voice of candidates and party committees and a vindication for all those who support robust, transparent political discourse. I am pleased that the Court agreed that limits on how many candidates or committees a person may support unconstitutionally burden core First Amendment political activities. When free speech is allowed to flourish, our democracy is stronger.”

James Bopp, Jr., lead attorney for RNC in the case and former RNLA Vice President for Election Education stated:

“This is a great triumph for the First Amendment. A robust republic requires free speech and association, which means no limits on how many candidates an individual may support with a legal contribution. Congress allows contributions to nine candidates, but not ten. How could giving to candidate number ten cause any corruption if giving to candidates one through nine doesn’t?”

“This is also a great victory for political parties, who have been disadvantaged recently by the rise of super-PACs.  Political parties serve vital purposes, such as tempering polarization, and this is a step in the right direction to re-empower them,” adds Bopp.

Furthermore, says Bopp: “The Court also rejected the FEC’s ‘wild hypotheticals’ about corruption that suggest fanciful scenarios that are otherwise illegal under current federal law. First Amendment rights cannot be suppressed by mere speculation or a vivid imagination.”

RNLA Chair Randy Evans summed up the effect of the decision:

“The implications for the upcoming Senate and House elections cannot be understated based on the Supreme Court’s decision.  Rather than have to limit the candidates they support, Americans can now support as many Senate and House candidates as they want along with all three of the national political organizations.”

Recap: 2013 Republican Lawyer of the Year Honoring George Terwilliger

Tuesday evening, RNLA held a reception in honor of the 2013 Republican Lawyer of the Year George J. Terwilliger III.  The reception featured stars of both the legal and political world gathering together to honor George’s incredible career.

The reception led off with a strong showing by former Virginia Senator John Warner. Although no longer in office, he has not lost a step.  RNLA 2012 Lawyer of the Year J.C. Boggs then introduced RNC Chairman Reince Priebus who both saluted George and thanked the RNLA.  Reince spoke about working with George back when he was the RNC General Counsel and working with RNLA as much as he is allowed to by law. 
Next, Senator Jeff Sessions spoke.  Senator Jeff Sessions had glowing remarks of George and discussed their time together as fellow U.S. Attorneys.  Senator Sessions also discussed current events a bit. He was incrediblly gracious and stayed around afterwards to meet the attendees.  Senator Sessions will always be an RNLA favorite and is a past winner of the RNLA Ed Meese Award. 

A few of George’s collegues, friends and those near and dear to him also spoke about him.  First, a key colleague in his government and professional career, Tim Flanigan, former Assistant Attorney General for the Office of Legal Counsel.  Next was former RNLA Chair David Norcross who spoke about George’s incredible career in political law.  Last in this group of speakers was George’s favorite, his son Zachary Terwilliger.  His son would neither confirm nor deny the rumor that George was born with his beard. 
George got up and gave a very heartwarming speech thanking many close to him.  George took a moment to recognize one special member of the crowd, a member of Seal Team 6, Peter Osyf.  Mr. Terwilliger also recognized his partner and fellow RNLA Award Winner, Fred Fielding in the audience.  Mr. Fielding was the 2013 RNLA Ed Meese award winner. 

2004 Republican Lawyer of the Year, Dick Wiley wrapped up the master of ceremonies duties, but the program was not quite done. 


The program closed with Senator Ted Cruz.  Senator Cruz was introduced by his former law partner Chuck Cooper.  He spoke about just missing George at Morgan Lewis and more importantly Senator Cruz spoke about working with George for long and insane hours in Florida in 2000 during the craziness that was the effort to confirm President George W. Bush’s narrow victory in 2000.  Mr. Terwilliger was a leader in that effort. 
 
Senator Cruz also spoke about the importance of the law, even in the Senate.  His speech was powerful and made an impact on the attendees.  The Senator was gracious enough to shake hands and take pictures with many of the attendees afterwards.

As important as the speeches and presentations were, the event was also thoroughly enjoyable to all who attended it.  In addition to share a glimpse into the career and life of one of the foremost Republican lawyers, guests were able to meet and get their pictures with the legal elite of law and politics. 

Congratulations to George.  We are proud to honor him as the 2013 Republican Lawyer of the Year.

State Legal Leaders Speaking at RNLA Conference


As RNC Chair and upcoming RNLA National Policy Conference Speaker Reince Priebus points out the strength of the Republican Party is in the states.  While DC is stuck in gridlock and not getting much done, it is in the states where ideas are happening and where the country is moving forward.

A key part of that effort is the great Republican Attorneys General.  The RNLA National Policy Conference will feature four of these leaders who will give a one-of-a-kind overview of the nation’s legal health from their perspectives.  And we are lucky to have four such great leaders attending and speaking.  In alphabetical order:

Virginia Attorney General Ken Cuccinelli will speak and sign copies of his book: The Last Line of Defense: The New Fight for American Liberty.  From the book description: 

With Obamacare and agencies like the EPA, the FCC, and the National Labor Relations Board attempting to exercise unprecedented control over the American people, the Obama Administration was breaking federal laws, ignoring federal courts, and violating the Constitution to achieve its goals of redistributing wealth, concentrating power in Washington, and rewarding its supporters.  Without enough lawmakers in Washington devoted to protecting the rule of law to stop the federal government's liberty-stealing power grab, the battle had to be waged in an unprecedented way: from the states -- just as our Founding Fathers intended.  The man who led the charge was Ken Cuccinelli, the first state attorney general to argue in federal court against Obamacare, an unapologetic defender of the Constitution, and a man admirers and detractors alike said "was tea party long before there was a Tea Party."  The Last Line of Defense provides a behind-the-scenes account of the myriad of legal battles in which our states were the only instruments of resistance to federal abuses of power.
While General Cuccinelli is coming to the end of his time as Attorney General, our next speaker West Virginia Attorney General Patrick Morrisey is just starting.  Morrisey is no stranger to the important legal battles of our day and has led them from inside Washington and in the court room.  A brief excerpt from his bio:

Prior to his election, Morrisey assisted in the successful multi-state challenge to the national health care law in the 11th Circuit Court of Appeals and counseled Members of Congress on strategies to repeal the law. He has also led successful efforts to thwart the federal government's efforts to impose price controls on health care products and seeks to limit the scope of federal regulations over our nation's health care system.  In addition to his health care expertise, Morrisey has handled administrative law, election law, public policy, and several criminal defense matters during his 21 year legal career.  Between 1999 to 2004, Morrisey served as the Deputy Staff Director and Chief Health Care Counsel to the House of Representatives Energy and Commerce Committee, helping draft and negotiate major legislation, including the Medicare Modernization Act of 2003 and the Bioterrorism and Public Health Preparedness Act of 2002.
Next up is Georgia Attorney General Sam Olens.   The charismatic General Olens has spoken frequently to RNLA events.  General Olens is leading in issues across the board from a statewide campaign against child sex trafficking on the “local” level to joining in national efforts challenging Dodd-Frank.  On the latter he wrote:

“Dodd-Frank violates basic principles of separation of powers and government that is accountable to the people.  It also gives the federal government the power to pick winners and losers, putting the State of Georgia’s financial assets at risk,” added Olens. “By joining this lawsuit, we are standing up for the Constitution, standing up for our local communities, and protecting our State’s finances.”

Our final speaker is long time RNLA Member Alabama Attorney General Luther Strange.  Prior to his election as Alabama’s 49th Attorney General, General Strange earned the reputation as one of Alabama's leading lawyers. He represented Hyundai when they located in Alabama along with many other companies, creating jobs across Alabama.  As Attorney General he is standing up for the second amendment as he recently wrote in response to the Senate Judiciary Committee’s actions:


The rights guaranteed us under the Second Amendment are fundamental and sacred. The Senate Democrats are using the tragedies that befell our nation to advance their political agenda. If these bills become law, I will move quickly to challenge them and protect Alabama citizens from this abusive federal overreach.

The RNLA is greatly honored to have all these legal leaders speaking at our April 26th Policy Conference.  It is in the states led by these Generals, that the battle to uphold the Constitution is being waged.
